According to Steve Wyrick (http://my.strathspey.org/dd/issue/1574/) and Bruce Herbold (http://my.strathspey.org/dd/issue/1576/) this jig tune is different from (and long predates) a reel tune of the same name by Gordon Pattullo.
Steve adds that the tune was published as "How Can We Abstain From Whisky" in the Captain Simon Fraser Collection (The Airs and Melodies Peculiar to the Highlands of Scotland and the Isles, 1817) but appears as "The Legacy" in several later collections (among them Kerr's, Ryan's Mammoth Collection, Howe's).
